Terms of Service

1. The service

Perspectify is a platform for observability, user feedback, and product operations. We may update, improve, or change features over time. We will give reasonable notice of material changes that adversely affect paid plans.

2. Accounts and organizations

You are responsible for the activity that happens under your account and organization, for keeping credentials secure, and for ensuring everyone you invite complies with these Terms. Organization owners and admins control roles, projects, and billing.

3. Acceptable use

You agree not to misuse the service. In particular, you will not:

• Send data you do not have the right to collect or process.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the service.
• Use the service to store or transmit unlawful, infringing, or harmful content.
• Exceed the project, seat, or usage limits of your plan through circumvention.

4. Plans, trials, and billing

Trial access is sales-led and may be offered before a paid plan begins. After the trial, fees are billed in advance on a monthly or annual basis through our payment processors. Fees are exclusive of taxes unless stated otherwise. See the Refund Policy for cancellation and refund terms.

5. Customer data and ownership

You retain all rights to the data you submit ("Customer Data"). You grant us a limited license to host and process Customer Data solely to provide the service. Our processing of personal data is described in the Privacy Policy and Data Processing Addendum.

6. Service availability

We work to keep the service available and reliable but do not guarantee uninterrupted access. Scheduled maintenance and incidents are communicated through our status pages.

7. Disclaimers and liability

The service is provided "as is" to the extent permitted by law. To the maximum extent permitted by applicable law, Digital David AG’s aggregate liability is limited to the fees paid for the service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law. [Confirm liability cap with legal counsel.]

8. Termination

You may stop using the service at any time. We may suspend or terminate access for material breach of these Terms. On termination, you may export Customer Data for a reasonable period before deletion.

9. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. To the extent permitted by law, the courts of Frankfurt am Main, Germany have jurisdiction over disputes.
